Who we are

This policy explains how Everly Watches ("we", "us", "our") collects, uses, and protects your personal data when you visit everlywatches.com or place an order with us. We are the data controller for the personal data described in this policy. You can contact us at contact@everlywatches.com. Our business address is 339 East Park Road, Leicester, LE5 5HL, United Kingdom. [EVERLY TO CONFIRM: legal company name and company number, if trading as a registered company rather than a sole trader; and whether a Data Protection Officer has been appointed — most small retailers don't need one, but state clearly if you have.]

Information we collect

We collect information you give us directly — such as your name, delivery and billing address, email address, telephone number, and payment details (processed securely by our payment provider; we don't store full card numbers) — when you place an order, create an account, contact us, or sign up to marketing. We also collect information automatically as you browse, such as pages viewed, device and browser type, and approximate location from your IP address, generally through cookies and similar technologies (see our Cookie Policy for full detail).

How we use your information, and our legal basis

• To process and fulfil your order, including payment, delivery, and customer service — necessary to perform our contract with you.
• To detect and prevent fraud and keep our store secure — our legitimate interest in protecting our business and customers, balanced against your rights.
• To send you order confirmations, shipping updates, and respond to enquiries — necessary to perform our contract with you.
• To send you marketing emails about new products or offers, where you've opted in — based on your consent, which you can withdraw at any time by using the unsubscribe link in any email or contacting us directly.
• To understand how our website is used and improve it, using analytics tools — based on your consent where required (see our Cookie Policy), or our legitimate interest in aggregated, non-identifying statistics where the law permits this without consent.
• To comply with our legal obligations, for example tax and accounting records.

Who we share your information with

We share personal data with the service providers who help us run the store, and only to the extent needed for them to provide their service to us:

• Shopify, our ecommerce platform provider, which processes data on our behalf to run the store, checkout, and order management.
• Our payment processor(s) — [EVERLY TO CONFIRM: e.g. Shopify Payments, PayPal, or others actually enabled at checkout] — to process your payment securely.
• Our courier(s) — [EVERLY TO CONFIRM: named courier/carrier(s)] — to deliver your order, who receive your name, address, and contact details for that purpose.
• Any fulfilment partner or supplier that dispatches your order on our behalf, including internationally where relevant — receiving only the information needed to pack and ship your item.
• Analytics and marketing tools — [EVERLY TO CONFIRM: e.g. Google Analytics, Meta Pixel, email marketing platform — list only tools actually installed]. None of these are enabled by default in this policy; we've flagged them so you update this list to match what's actually running on the store.
• Law enforcement or regulators, where we're legally required to.

We don't sell your personal data to third parties.

International transfers

Some of our service providers, or fulfilment/supplier locations, may be based outside the UK — for example, where products are dispatched from an international fulfilment location. Where personal data is transferred outside the UK, we rely on legally recognised safeguards, such as the UK's International Data Transfer Agreement or adequacy regulations, to keep it protected to UK standards.

How long we keep your information

We keep order and transaction records for as long as needed to meet our legal and tax obligations (typically at least 6 years in the UK), and marketing preference data until you unsubscribe or ask us to delete it. Account information is kept for as long as your account is active.

Your rights

Under UK data protection law, you have the right to: access the personal data we hold about you; have inaccurate data corrected; ask us to delete your data in certain circumstances; restrict or object to certain processing; receive your data in a portable format; and withdraw consent at any time where we rely on consent. To exercise any of these, email contact@everlywatches.com. If you're unhappy with how we've handled your data, you also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or 0303 123 1113.

Automated decision-making

We don't use your personal data to make any decision that has a legal or similarly significant effect on you without human involvement. Standard automated fraud-screening on payments may flag an order for manual review, but doesn't decide the outcome for you on its own.

Children

Our website and products are intended for adults. We don't knowingly collect personal data from children.

Changes to this policy

We may update this policy from time to time to reflect changes in our practices or the law. The current version will always be available on this page.

EVERLY ACTION REQUIRED: fill in the three [EVERLY TO CONFIRM] lists above (payment processor(s), courier(s), and any analytics/marketing tools) with what's actually connected to your store before publishing — an inaccurate list is itself a compliance risk, not just a placeholder problem.
