1. About Everly Watches
These Terms govern your use of everlywatches.com (the "Site") and any purchase you make from Everly Watches ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms.
2. Eligibility
You must be at least 18, or have a parent or guardian's permission, to place an order with us.
3. Website use
You may browse and use the Site for your own personal shopping. You must not misuse it — for example by attempting unauthorised access, introducing malicious code, or scraping our content.
4. Product descriptions
We take reasonable care to describe our products accurately, including movement type, materials, and features.
5. Product images
Product photos are intended to represent the item accurately; minor colour variation due to your screen's display can occur and isn't itself a fault.
6. Watch specifications
Technical specifications (movement, case size, strap material, compatibility for smart watches) are provided as accurately as we know them at the time of listing. Always check the specification against your needs before ordering, particularly for smart watch compatibility.
7. Prices
All prices are shown in GBP and include VAT where applicable. [EVERLY TO CONFIRM: state here once you register for VAT — until then, do not claim a VAT number applies.]
8. Taxes
For orders delivered outside the UK, additional import duties or taxes may apply on arrival — see section 17 below.
9. Orders
Placing an order is an offer by you to buy; we'll send an order confirmation acknowledging receipt.
10. Order acceptance
The contract between us is formed when we send you a dispatch confirmation, not before. We may decline or cancel an order before dispatch — for example due to a pricing error, stock unavailability, or suspected fraud — in which case you'll receive a full refund.
11. Payment
Payment is processed securely through Shopify's checkout and our payment provider(s). We don't see or store your full card details.
12. Fraud prevention
We use standard fraud-screening measures to protect our business and genuine customers, and may ask for additional verification on some orders before dispatch.
13. Stock availability
Occasionally an item may sell out before your order is processed. If that happens, we'll contact you promptly and offer a refund or alternative.
14. Pricing errors
If we discover a pricing or listing error on an order that hasn't been dispatched, we'll contact you before proceeding, and you can confirm at the correct price or cancel for a full refund.

16. International fulfilment
Orders may be dispatched from one of our UK or international fulfilment locations, depending on the item and stock availability. Everly Watches remains fully responsible to you as the retailer regardless of where an order is fulfilled from — using an international fulfilment partner doesn't reduce your rights or our responsibilities under these Terms.
17. Customs and duties
For international orders, import duties, customs fees, or local taxes may be payable on delivery, depending on your country's rules. [EVERLY TO CONFIRM: whether Everly Watches pays these costs (DDP) or the customer pays them on delivery (DAP/DDU) — this must be confirmed and stated clearly before you enable international shipping.]
18. Cancellation rights
If you're a UK consumer, you have a statutory right to cancel your order within 14 days of delivery without giving a reason, under the Consumer Contracts Regulations 2013 — see our Return and Refund Policy for how to exercise this.

20. Faulty products
If your item is faulty, your rights under the Consumer Rights Act 2015 apply regardless of any other policy — see our Return and Refund Policy for the tiered remedies (replacement, refund, or price reduction) that apply depending on how long you've had the item. We don't offer in-house repairs, so we address faults by replacement or refund rather than repair, coordinating with the manufacturer's warranty where one applies. Because we're the retailer rather than the manufacturer of the watches we sell, your contract — and your legal right of redress for a faulty item — is with us, not the manufacturer, exactly as it would be buying a third-party brand from any other UK retailer.
21. Refunds
Refunds are processed to your original payment method, normally within 14 days of us receiving a return or confirming a fault.
22. Smart watches
Smart watches should be checked against their stated compatibility requirements (operating system, Bluetooth version, companion app) before purchase. Please back up and remove your personal data before returning a smart watch — see our Return and Refund Policy.
23. Batteries
Battery-powered watches are supplied with a battery in normal working condition. Ordinary battery depletion over time through normal use is expected and isn't a fault; a battery or watch that fails to function correctly from new is covered under section 20 above.
24. Water-resistance claims
Where a product listing states a water-resistance rating (for example, in metres or ATM), that rating applies under the specific test conditions stated and may not reflect real-world use such as swimming, diving, or showering unless the listing says so explicitly. We don't describe any watch as "waterproof," since no watch is completely impervious to water in all conditions. Always check the specific product listing for what its rating actually covers.
25. Product use
Please use your watch in line with any care instructions provided with it. Damage caused by misuse, impact, or use outside the product's stated specifications isn't covered as a fault.
26. Normal wear and tear
Cosmetic changes that develop through normal use over time — such as minor scratching to a strap or case, or gradual fading — are normal wear and tear, not a fault, and are different from a defect that was present when the item was delivered to you.
27. Promotions
Any promotion we run will state its own specific terms, including eligible products and dates, at the time it's offered.
28. Discount codes
Discount codes are single-use unless stated otherwise, can't usually be combined with other offers, and may be withdrawn or amended before use if applied in error.
29. Intellectual property
The Site's content — text, images, logos, and design — belongs to or is licensed to Everly Watches and is protected by copyright and related laws. You may not reproduce or reuse it without our permission, beyond what's needed for normal browsing and purchasing.
30. Prohibited use
You must not use the Site for any unlawful purpose, to infringe anyone's rights, or to disrupt the Site's operation.
31. Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't lawfully be limited under English law. Subject to that, our liability for losses arising from your order or use of the Site is limited to the value of your order, and we're not liable for indirect or consequential losses.
32. Events outside reasonable control
We won't be liable for delay or failure to meet our obligations caused by events beyond our reasonable control, such as extreme weather, carrier disruption, or industrial action.
33. Privacy
Our Privacy Policy explains how we collect and use your personal data, and forms part of these Terms.
34. Complaints
If something's gone wrong, please contact contact@everlywatches.com first so we can put it right. If we can't resolve things directly, you may be able to use a certified Alternative Dispute Resolution provider or the EU/UK Online Dispute Resolution options where applicable to you.
35. Governing law
These Terms are governed by the laws of England and Wales, and any disputes are subject to the courts of England and Wales — without affecting any mandatory consumer protections that apply to you in your own country of residence if you're ordering from outside the UK.
36. Statutory consumer rights
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or any other law that can't be excluded by agreement.
37. Changes to these terms
We may update these Terms from time to time to reflect changes in our business or the law. Changes won't apply retroactively to orders already placed, and the current version is always available on this page.
